Piscean Aquarium Services – Terms and Conditions
Effective Date: 22 September 2024
By engaging the services of Piscean Aquarium Services (“Piscean”, “we”, “us”, or “our”), you (“Client”, “you”, or “your”) agree to the following Terms and Conditions. Please read them carefully before booking or continuing service.
1. Payment Terms
Payment is due as stipulated on the invoice. Cash on arrival is available when discussed prior to service. Accepted payment methods include credit card, debit card, and electronic bank transfer. All prices are exclusive of GST unless otherwise stated and are subject to applicable taxes and fees. All payments made are non-refundable except where required by law.
2. Service Rates
Our ongoing service rate is variable depending on location and agreed upon prior to booking, starting at $169 to $249 inclusive of travel time, water parameter testing, and water treatments. This rate excludes additional purchases such as livestock, décor, medications, filter media, or other items, and excludes GST. ”Ongoing” is a minimum of 10 services at agreed frequency of 2, 3, or 4 weeks. Ongoing clients who end service agreements prior to min 10 services in an Ongoing agreement will incur a backcharge to One Time rates for services provided.
Our out-of-hours rate (7 pm – 8 am) or One Time Call Out is from $249 per hour, inclusive of travel time, water parameter testing, and water treatments, and exclusive of GST and additional purchases as listed above. These prices include a portion of travel time when services are performed within our advertised service areas — Northern Beaches, North Shore, and Eastern Suburbs.
3. Outside Areas
Booking requests outside these areas may incur an additional travel charge to cover time and distance incurred, including tolls, fuel, or other associated costs. Agreed prior to booking.
4. Livestock and Plant Disclaimer
Piscean makes no claims, guarantees, or warranties regarding livestock (fish or plants). Due to the sensitive nature of aquatic livestock during transport, transition, and within supply chains, Piscean is not liable for any losses, illness, or mortality of livestock or plants at any stage of the process.
5. Cancellations and Rescheduling
Cancellations or rescheduling requests must be made at least 48 hours prior to the scheduled appointment to allow for preparation, travel, and collection of supplies. Failure to provide 48 hours’ notice, or a no-show at the scheduled appointment, will incur a cancellation fee of $129 + GST. If products or materials were pre-purchased specifically for your booking, additional charges may apply to cover those costs.
6. Deposits
Partial deposits are required prior to any installation, design, or custom work. These deposits are non-refundable once paid, as they cover material sourcing, design preparation, and scheduling commitments.
7. Additional Purchases
Where required, additional items such as décor, medications, livestock, plants, or equipment may be supplied at the discretion of Piscean staff. These products will be invoiced separately and must be paid for by the Client.
8. Limitation of Liability
Piscean is not liable for any damage to fish, plants, livestock, furniture, aquariums, property, or premises resulting from leaks, water exposure, equipment failure, or other unforeseen causes. All work is carried out with due care, but aquarium systems involve inherent risks that are the responsibility of the owner once service is completed.
9. Conduct and Behaviour
Piscean maintains a zero-tolerance policy towards aggressive, abusive, or unprofessional behaviour directed toward our staff. We reserve the right to immediately terminate service without refund if such conduct occurs. Piscean values a respectful and professional working relationship with all clients.
10. Scheduling and Access
Appointments are scheduled within business hours and must be accessible at the agreed-upon time. Failure to provide access will be treated as a cancellation and subject to the cancellation fee. Piscean reserves the right to reschedule services in the event of emergency or unforeseen circumstances.
11. Privacy and Data
Piscean collects and stores only the personal information necessary to provide services, communicate with clients, and meet legal obligations. Client information is not shared with third parties except where required for billing, logistics, or legal compliance, in accordance with NSW and Australian privacy laws.
12. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
Acknowledgment
By engaging Piscean Aquarium Services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Piscean reserves the right to update these Terms at any time. Clients are encouraged to review them periodically for any updates or changes.
